Most couples need to have their assets as joint assets so if one passes away the assets automatically go to the other person. To qualify for the programs these things have to be placed in the non-disabled person’s name. For property this is accomplished by filing a fast claim deed. It’s an easy process, yet many of us don’t wish to risk the demise of the healthy partner.

The drawback is the property will have to go thru probate.

A similar thing can be done by changing joint bank accounts to only one person’s name. Convincing folks to give up their share in property and cash is a touchy subject. It doesn’t appear fair to them that they must sign over things that they were hard workers to realize. It is a tough choice for folk to make, but it can let them stay in their home.
